Personal data (usually referred to just as “data” below) will only be processed by us to the extent necessary and for the purpose of providing a functional and user-friendly website, including its contents, and the services offered there.

Per Art. 4 No. 1 of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as the “GDPR”), “processing” refers to any operation or set of operations such as collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment, or combination, restriction, erasure, or destruction performed on personal data, whether by automated means or not.

The following privacy policy is intended to inform you in particular about the type, scope, purpose, duration, and legal basis for the processing of such data either under our own control or in conjunction with others. We also inform you below about the third-party components we use to optimize our website and improve the user experience which may result in said third parties also processing data they collect and control.

II. The rights of users and data subjects

With regard to the data processing to be described in more detail below, users and data subjects have the right

  • to revoke their consent at any time (cf. also Art. 7 Para. 3 GDPR);
  • to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (cf. also Art. 15 GDPR);
  • to correct or complete incorrect or incomplete data (cf. also Art. 16 GDPR);
  • to the immediate deletion of data concerning them (cf. also Art. 17 DSGVO), or, alternatively, if further processing is necessary as stipulated in Art. 17 Para. 3 GDPR, to restrict said processing per Art. 18 GDPR;
  • to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers (cf. also Art. 20 GDPR);
  • to object to the processing of personal data concerning them (cf. also Art. 21 GDPR);
  • to file complaints with the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions (see also Art. 77 GDPR).

In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Nevertheless, users have a right to information about these recipients.

Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller’s future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

III. Information about the data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.

Server data

For technical reasons, the following data sent by your internet browser to us or to our server provider will be collected, especially to ensure a secure and stable website: These server log files record the type and version of your browser, operating system, the website from which you came (referrer URL), the webpages on our site visited, the date and time of your visit, as well as the IP address from which you visited our site.

The data thus collected will be temporarily stored, but not in association with any other of your data.

The basis for this storage is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website.

The data will be deleted within no more than seven days, unless continued storage is required for evidentiary purposes. In which case, all or part of the data will be excluded from deletion until the investigation of the relevant incident is finally resolved.

Cookies

a) Third-party cookies

If necessary, our website may use cookies from companies with whom we cooperate for the purpose of improving the features of our website. Cookies are small text files or other storage technologies stored on your computer by your browser.

Please refer to the following information for details, in particular for the legal basis and purpose of such third-party collection and processing of data collected through cookies.

b) Disabling cookies

You can refuse the use of cookies by changing the settings in your browser. Likewise, you can use the browser to delete cookies that have already been stored. However, the steps and measures required vary, depending on the browser you use. Browser settings cannot prevent so-called flash cookies from being set. Instead, you will need to change the setting of your Flash player. Order processing

The data you submit when ordering goods and/or services from us will have to be processed in order to fulfill your order. Please note that orders cannot be processed without providing this data.

The legal basis for this processing is Art. 6 Para. 1 lit. b) GDPR.

We delete your personal data after the contract has been fully executed, but only after the retention periods required by tax and commercial law have expired.

In order to process your order, we will share your data with the shipping company responsible for delivery to the extent required to deliver your order and/or with the payment service provider to the extent required to process your payment.

The legal basis for the transfer of this data is Art. 6 Para. 1 lit. b) GDPR.

Newsletter

If you register for our free newsletter, the data requested from you for this purpose, i.e. your email address and, optionally, your name and company, will be sent to us. We also store the IP address of your computer and the date and time of your registration. During the registration process, we will obtain your consent to receive this newsletter and the type of content it will offer, with reference made to this privacy policy. The data collected will be used exclusively to send the newsletter and will not be passed on to third parties.

The legal basis for this is Art. 6 Para. 1 lit. a) GDPR.

You may revoke your prior consent to receive this newsletter under Art. 7 Para. 3 GDPR with future effect. All you have to do is inform us that you are revoking your consent. You can also manage the subscription yourself at any time by clicking on the “Manage subscriptions” link at the end of each newsletter. Follow the instructions given there to cancel your subscription. Your personal data will be deleted within 7 days after the end of your subscription.

Contact

If you contact us via email or the contact form, the data you provide will be used for the purpose of processing your request. We must have this data in order to process and answer your inquiry; otherwise we will not be able to answer it in full or at all.

The legal basis for this data processing is Art. 6 Para. 1 lit. b) GDPR.

Your data will be deleted once we have fully answered your inquiry and there is no further legal obligation to store your data, such as if an order or contract resulted therefrom.

Twitter Online Presence

We maintain an online presence on Twitter to present our company and our services and to communicate with customers/prospects. Twitter is a service provided by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA.

We would like to point out that this might cause user data to be processed outside the European Union, particularly in the United States. This may increase risks for users that, for example, may make subsequent access to the user data more difficult. We also do not have access to this user data. Access is only available to Twitter.

YouTube Online Presence

We maintain an online presence on YouTube to present our company and our services and to communicate with customers/prospects. YouTube is a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, a subsidiary of Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043 USA.

We would like to point out that this might cause user data to be processed outside the European Union, particularly in the United States. This may increase risks for users that, for example, may make subsequent access to the user data more difficult. We also do not have access to this user data. Access is only available to YouTube.

LinkedIn Online Presence

We maintain an online presence on LinkedIn to present our company and our services and to communicate with customers/prospects. LinkedIn is a service of LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland, a subsidiary of LinkedIn Corporation, 1000 W. Maude Avenue, Sunnyvale, CA 94085, USA.

We would like to point out that this might cause user data to be processed outside the European Union, particularly in the United States. This may increase risks for users that, for example, may make subsequent access to the user data more difficult. We also do not have access to this user data. Access is only available to LinkedIn.

We also integrate the following social media sites into our website. The integration takes place via a linked graphic of the respective site. The use of these graphics stored on our own servers prevents the automatic connection to the servers of these networks for their display. Only by clicking on the corresponding graphic will you be forwarded to the service of the respective social network.

Once you click, that network may record information about you and your visit to our site. It cannot be ruled out that such data will be processed in the United States.

Initially, this data includes such things as your IP address, the date and time of your visit, and the page visited. If you are logged into your user account on that network, however, the network operator might assign the information collected about your visit to our site to your personal account. If you interact by clicking Like, Share, etc., this information can be stored your personal user account and possibly posted on the respective network. To prevent this, you need to log out of your social media account before clicking on the graphic. The various social media networks also offer settings that you can configure accordingly.

Embedded YouTube Videos

We use YouTube on our website. This is a video portal operated by YouTube LLC, 901 Cherry Ave, 94066 San Bruno, CA, USA, hereinafter referred to as “YouTube”.

YouTube is a subsidiary of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”.

We use YouTube in its advanced privacy mode to show you videos. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in improving the quality of our website. According to YouTube, the advanced privacy mode means that the data specified below will only be transmitted to the YouTube server if you actually start a video.

Without this mode, a connection to the YouTube server in the USA will be established as soon as you access any of our webpages on which a YouTube video is embedded.

This connection is required in order to be able to display the respective video on our website within your browser. YouTube will record and process at a minimum your IP address, the date and time the video was displayed, as well as the website you visited. In addition, a connection to the DoubleClick advertising network of Google is established.

If you are logged in to YouTube when you access our site, YouTube will assign the connection information to your YouTube account. To prevent this, you must either log out of YouTube before visiting our site or make the appropriate settings in your YouTube account.

For the purpose of functionality and analysis of usage behavior, YouTube permanently stores cookies on your device via your browser. If you do not agree to this processing, you have the option of preventing the installation of cookies by making the appropriate settings in your browser. HetrixTools (Status Dashboard)

We use HetrixTools to monitor the availability of our services, and to provide the status dashboard accessible at status.mergeboard.com. HetrixTools is a service provided by HetrixTools, Inc. located in 9450 SW Gemini Dr, PMB 23419; Beaverton, Oregon, 97008-7105; United States, hereinafter referred to as “HetrixTools”.

For the purpose of monitoring our services, no personal data is shared with HetrixTools. However, in order to access the status dashboard, a connection from your browser to the HetrixTools servers must be established. When accessing the dashboard, HetrixTools may record your IP address, the date and time of access, as well as the website you visited.

If you are logged in to HetrixTools when you access the status dashboard, HetrixTools may assign the connection information to your HetrixTools account. To prevent this, you must log out of HetrixTools before visiting our status dashboard.

Calendly (Schedule a Demo)

On our website we offer you the opportunity to schedule an appointment with one of our representatives. For this purpose we use Calendly. Calendly is a service provided by Calendly, LLC, 1315 Peachtree St NE, Atlanta, GA 30309, USA, hereinafter referred to as “Calendly”.

Calendly is loaded only when you click on the “Schedule a Demo” button. If you do not wish to use Calendly, please use our contact form to schedule an appointment instead or contact us directly via email.

To register an appointment via Calendly, click the “Schedule a Demo” button, select a suitable date and time and fill out the form with your contact details. The data you provide will then be transmitted via Calendly to the respective contact person and will be entered into our calendar (Google). You will receive a confirmation of the appointment by email, where you have the option to enter the data in your own calendar.

The purpose of processing the data provided is to be able to make an appointment, process the contact request and get in touch with you. The legal basis for the processing of personal data described here is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest is to offer you the opportunity to independently arrange appointments with us.

Calendly uses cookies, web beacons and other technologies to receive and store certain types of information when you interact with Calendly through a computer or mobile device subject to Calendly’s opt-out preferences.

When you use Calendly, their servers automatically record information (“log data”), including information that your browser sends whenever you visit the Calendly website. This log data may include the web address you came from or are going to, the device model, operating system, browser type, unique device identifier, IP address, mobile network carrier, and time zone or location.

Since Calendly’s servers are located in the United States, personal data will be transferred to, processed, and stored in the United States or other jurisdictions, which may not offer the same level of privacy protection as those in the country where you reside or are a citizen.

Matomo (Website Analytics)

This website uses the open source web analytics platform Matomo to measure, collect, analyse and report visitors data for purposes of understanding and optimizing our web presence. For example, it helps us to identify not found pages, search engine indexing issues, and which contents are most appreciated. Also, it helps us to identify if the way we are communicating is engaging or not and how we can organize the structure of the website better. Our team is benefiting from the processing of your personal data, and uses reports generated by Matomo to take action, for example changing the layout of the pages, publishing fresh content, etc. By processing your personal data, you can profit from a website which is getting better and better.

Matomo is processing the following personal data:

  • Title of the page being viewed
  • URL of the page being viewed
  • URL of the page that was viewed prior to the current page
  • Screen resolution
  • Time in local timezone
  • Files that were clicked and downloaded
  • Link clicks to an outside domain

  • User Agent of the browser
  • Form interactions
  • Media interactions
  • Through which campaign the website was reached

The data thus collected will be anonymized by masking parts of the IP address and is not stored in association with any other of your other data.

The basis for this storage is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website. Without the data, we would not be able to provide you the service we are currently offering to you. Your data will be used only to improve the user experience on our website and help you find the information you are looking for.

Matomo data is hosted on our own servers located in Germany. The data will be deleted after a period of 6 months.
